A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, January 8, 2019. On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 7:15 p.m.  On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, the work session closed at 7:29 p.m.

On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the Board entered into Executive Session at 7:30 p.m. to discuss sensitive properties.

On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried the executive session closed at 8:05 p.m. and the meeting adjourned.

Regular meeting of the Board of Trustees opened at 8:07 p.m.

The Pledge of Allegiance was led by Trustee Davida.

On the motion of Trustee Muldowney seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the minutes of the December 11th, 2018 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated December 23, 2018:

At the regular monthly meeting of the Fire Council held December 18, 2018, the Fire Council took the following actions and we await your approval:

Placed on Sick Leave:

            Timothy Bridges effective December 1, 2018

            Anthony Rizzo effective December 3, 2018

Took off Sick Leave with Medical Clearance:

On the motion of Trustee Muldowney seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Adams seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue refunds in the amounts indicated below to each of the applicants listed for the return of ZBA sign(s) for partial refund:

On the motion of Trustee Adams seconded by Trustee Davida and unanimously carried, it was

RESOLVED to terminate the employment of Hykiem Manning as a part-time sanitation laborer effective December 27, 2018.

On the motion of Trustee Adams seconded by Trustee Davida and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, November 27, 2018, to consider the application of Christopher Paulicelli, 101 Deer Park Avenue LLC, to add an entryway on the north side of the building located at 99-101 Deer Park Avenue, and

WHEREAS the application was approved at the regular meeting of the Board of Trustees held November 27, 2018, subject to Covenants & Restrictions to follow,

BE IT HEREBY RESOLVED to approve and adopt the attached Covenants & Restrictions for 99-101 Deer Park Avenue.   [Section 010 / Block 04 / Lots 008]

On the motion of Trustee Adams seconded by Trustee Davida and unanimously carried, it was

RESOLVED to terminate the employment of Craig Baisley as a laborer effective December 27, 2018.

RESOLVED to issue a refund to Herman Katz Cangemi & Clyne LLP, in the amount of $492.69, for the 2017/18 Tax year, as per the attached court-ordered settlement on behalf of Fairfield Victorian Residences, LLC, for the property located at 163 Fire Island Avenue, Babylon.

On the motion of Trustee Davida seconded by Trustee Adams and unanimously carried, it was

RESOLVED that the Treasurer of the Village of Babylon be directed to hold a Tax Sale at the Municipal Building at 153 West Main Street, Babylon, New York, on Saturday, the 23rd day of February, 2019, at 10:00 a.m.

On the motion of Trustee Silvestri seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon Beautification Society to use Babylon Village facilities / venues for the Babylon Beautification Society fundraisers / events in 2019, as per the attached.  This permission is granted contingent upon timely receipt of required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Muldowney seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to issue a refund in the amount of $100.00 to Dominick Pepito for the Architectural Review Board Application fee paid in error for the property located at 11 Suydam Place, Apt. #2; the business is not a permitted use in the retail business zone without prior Board Approvals.

On the motion of Trustee Muldowney seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to terminate Maria Antonelli as a part-time clerk typist in the Building Department effective December 27, 2018.

On the motion of Trustee Muldowney seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED that the locations on the attached list are hereby designated as Polling Places for the General Village Election to be held on March 19, 2019.  Polling Places will be open on said day between the hours of 7:00 a.m. and 9:00 p.m.

This Election is for Mayor and two Trustees, each for a term of four years.

The Board noted that one polling place changed for this election from the Grade School to the High School.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the resignation of Rachel Scelfo as a member of the Zoning Board of Appeals effective January 8, 2019.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to appoint John Farrell as a member of the Zoning Board of Appeals to fill the unexpired term of Rachel Schelfo, which is to April of 2019.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law #1 of 2019, to amend Chapter 122 Article II, by adding 122-8 (F.) Mooring and Anchoring and 122-8 (G.) Removal of dangerous, unseaworthy, and disabled vessels.

and therefore,

BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, January 8, 2019,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law #1 of 2019, is HEREBY ADOPTED as:

Local Law 1 of 2019, to amend Chapter 122 Article II, by adding 122-8 (F.) Mooring and Anchoring and 122-8 (G.) Removal of dangerous, unseaworthy, and disabled vessels.

Mayor Scordino made the following announcement:

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, January 21, 2019, in observance of the Martin Luther King Day Holiday.  Residents are reminded that they should not put rubbish or recycling out to the curb on holidays.
