A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, January 15, 2013.  On the motion of Trustee Muldowney, seconded by Trustee Basile the meeting was opened at 3:59pm.  There were no resolutions adopted. On the motion of Trustee Amelia and seconded by Trustee Muldowney the meeting was adjourned at 6:01pm.

Regular meeting of the Board of Trustees opened at 8:05 p.m.

The Pledge of Allegiance was lead by Trustee Basile

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED TO: approve the minutes of the January 8, 2013 regular board meeting and dispense with the reading of the same.

 The Village Clerk read the letter from the Fire Department:

 At the regular monthly meeting of the Fire Council held January 15, 2013, the Fire Council took the following actions and we await your approval:

  1. Placed Barbara Maier of the Argyle Hose on sick leave as of December 19, 2012.
    1. Placed Daniel Dobush of the Fire Patrol on sick leave as of November 22, 2012.
  2. Added Kevin Kelland to the Driver’s List of Unit 1-2-7.
  3. Placed Dawn Losse Rescue Squad on sick leave as of January 3, 2013.
  4. Accepted Jason Witthohn of the Argyle Hose as an Active Member following successful completion of his Probationary period.
  5. Accepted Timothy Bridges of the Electric Hose as an Active Member following successful completion of his Probationary period.
  6. Accepted the resignation, with regret, of FFE Marisa Reeves from the Department.
  7. Accepted Shawn Dimperio as a Probationary Member of the Sumpwams Hose.

On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried it was 

RESOLVED TO accept the fire department actions as read

 On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED TO:  issue refund in the amount of $28.71 for overpayment of taxes on    Section 20  Block 1  Lot 61, 70 Lee Ave.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED TORemove and replace on the tax roll for the 2013-2014 tax year, Alternative Veterans Exemptions in the amount of 3,600  in assessed value, and approve additional applications in the amount of 3,484 in assessed value.  Total Alternative Veterans (Combat & Non-Combat combined) Exemptions for the 2013-14 tax year are

103,929 in assessed value as per the attached listing, which is an increase in the amount of 142 in assessed value from 2012

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED TO:  approve new Disability Exemptions in the  amount of 2,495  in assessed value for the 2013-2014 tax year as per the attached

On the motion of Trustee Basile, seconded by Trustee Muldowney, and unanimously carried it was

RESOLVED TO:  accept the resignation of James Brucia from the Zoning Board of Appeals as of January 22, 2013.

On the motion of Trustee Muldowney, seconded by Trustee Basile, and unanimously carried it was

RESOLVED:  that the Receiver of Taxes for the Village of Babylon be authorized to close the tax year 2012-2013 on January 22, 2013, and return the tax roll and warrant as required by Section 1426 of the Real Property Tax Law, as per attached.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried it was

RESOLVED TO:  hire Laura Milazzo as a full time clerk in the Highway Department with an annual salary of $25,000 effective January 2, 2013.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried it was

RESOLVED TO:  Remove exemptions and restore full assessment to the following properties, and bill new owners a total of:

RESOLVED TO:  remove the following exemption, and restore full assessment to Section 3  Block 2  Lot 34,  67 WASHINGTON ST- formerly owned by ROBERT KREPIL SR, an Eligible Fund Veterans Exemption with an assessed value of 4400 and bill the new owners, ROBERT P & MARISA KREPIL $340.69- which is for 217 days @ $1.57 per day for the 2012-2013 tax year

RESOLVED TO: remove the following exemption, and restore full assessment to   Section 16  Block 2  Lot 5,  40 REID AVENUE- formerly owned by MURPHY, an Eligible Fund Veterans Exemption with an assessed value of 3100 and bill the new owners, PETER AND JENNIFER SMALDONE $392.94- which is for 354 days @ $1.11 per day for the 2012-2013 tax year

RESOLVED TO:  remove the following exemption, and restore full assessment to   Section 18  Block 2  Lot 35,  10 MIDWAY ST- formerly owned by BERNADETTE YANDER, an Alternative Veterans Exemption with an assessed value of 500 and bill the new owner, DIANE YANDER, $52.92- which is for 294 days @ .18¢ per day for the 2012-2013 tax year

RESOLVED TO: remove the following exemption, and restore full assessment to Section 19  Block 1  Lot 23, 68 ARACA ROAD-formerly owned by CONNELLY, an Eligible Fund Veterans Exemption with an assessed value of 4000 and bill the new owner, LINDA PARISE $434.72- which is for 304 days @ $1.43 per day for the 2012-2013 tax year

On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED TO:  appoint Jeannine Finelli Deputy Village Clerk through March 2013.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried it was

RESOLVED TOappoint Jeannine Finelli Secretary to the Board of Trustees through March 2013.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried it was

RESOLVED TO: remove and replace on the tax roll for the 2013-2014 tax year, Senior Citizens Exemptions in the amount of  85,536  in assessed value, and approve additional applications in the amount of  6,949  as per the attached.  The total assessed value of Senior Citizen Exemtions decreased by _6919 for 2013.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried it was

RESOLVED TO:  remove and replace on the tax roll for the 2013-2014 tax year, Eligible Funds Veterans Exemptions in the amount of  26,950  in assessed value, and renew exemptions in the amount of ­­­­­­­­­­­454,777  in assessed value, as per the attached listing.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried it was

RESOLVED TO:  grant permission to the Babylon Village Arts Council to hold their sixth annual Outdoor Art Exhibit at Argyle Park, on May 18 & May 19, 2013 from 10:00am – 4:30pm.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried it was

RESOLVED TO: approve the following warrant for January 22, 2013

General Account:

            919.15

Total General Fund:

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried it was

RESOLVED:   that the Board of Trustees or a majority thereof shall constitute the Board of Review to hear complaints in relation to assessments on Tuesday, February 19, 2013 at the Municipal Building, 153 West Main Street, Babylon, New York between the hours of 1:00 P.M. and 5:00 P.M.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried it was

RESOLVED TO:  appoint Poll Inspectors and Alternates for the Village Election to be held March 19, 2013, as per the attached list.  Payment for the day will be $160, with additional $10 for the chairperson at each Election District.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried it was

RESOLVED TO:  dispose of the following records as per the New York State archives records retention schedule MU-1:  Warrant books dated June 1, 1999 through May 31, 2006.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED TO:  grant Culery Jeffries a license to drive a taxi for Lindy’s Taxi in the Village of Babylon.

On the motion of Mayor Scordino, seconded by Trustee Davida and unanimously carried it was

RESOLVED TO:  grant Helen Duguay a license to drive a taxi for Lindy’s Taxi in the Village of Babylon.

On the motion of Mayor Scordino, seconded by Trustee Basile and unanimously carried it was

RESOLVED TO:  grant Jennifer Grinberg a license to drive a taxi for Lindy’s Taxi in the Village of Babylon.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED TO:  grant Christopher Grassia a license to drive a taxi for Sunset Taxi in the Village of Babylon.

On the motion of Mayor Scordino, seconded by Trustee Davida and unanimously carried it was

RESOLVED TO:  grant Charles Perrotta a license to drive a taxi for Sunset Taxi in the Village of Babylon.

Mayor Scordino resolved to schedule bid openings as follows:

-Bid opening for the Concrete Retaining Wall at the pool is rescheduled (from January 17th) to Thursday January 31, 2013.

-Bid opening on Thursday, January 31, 2013 at 9:30am for Bulkhead Replacement at the Village Pool.  Plans and specs are available in the office of the Village Clerk.

-Re-Bid on Roofing & Building Repairs at the Village Pool on Thursday, February 14, 2013 at 9:30am.  Original bid opening was held on Thursday, January 17th.  Plans and specs will be available in the office of the Village Clerk on January 31, 2013.

-Bid opening for Bulkhead Replacement at Lewis Pond on Thursday, February 21, 2013.  Plans and specs will be available in the office of the Village Clerk on Thursday, February 7, 2013.

Mayor Scordino made the following announcements:

There will be two Public Hearings on Tuesday, February 12, 2013 to consider the adoption of:

Local Law #1 of the year 2013 which is a local law authorizing a property tax levy increase in excess of the limit established in General Municipal Law 3-C (2%)

Local Law #2 which allows for the awarding of bids based on Best Value in lieu of lowest bidder.
