A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, December 20th, 2016.  On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 5:40 p.m.  On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, the meeting adjourned at 6:00 p.m.

Regular meeting of the Board of Trustees opened at 8:02 p.m.

The Pledge of Allegiance was led by Trustee Adams.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the December 13th, 2016, regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Chamber of Commerce to hold the 2017 events, with sidewalk access, listed below and as per the attached.  This permission is granted contingent upon timely receipt of required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to re-appoint Theresa Bunger to the Architectural Review Board for a three year term which will expire November of 2019.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to St. Nicholas Greek Orthodox Church to use Argyle Park at 12:00 Noon on Sunday, January 15th, 2017, for the annual Blessing of the Waters (which is rescheduled from the original date of January 8th, 2017).  This permission is granted contingent upon timely receipt of required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to accept the resignation of Christopher Resch as an alternate member of the Zoning Board of Appeals, effective December 7, 2016.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the Babylon Beautification Society to use Babylon Village facilities / venues for the Babylon Beautification Society fundraisers / events in 2017, listed below and as per the attached. This permission is granted contingent upon timely receipt of required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED that the locations on the attached list are hereby designated as polling places for the General Village Election to be held on March 21, 2017.  Polling places will be open on said day between the hours of 7:00 a.m. and 9:00 p.m. [This Election is for two Trustees and the Village Justice, each for a term of four years.]

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to approve the following warrant for January 10, 2017:

General Account:                    $ 368,644.18

TOTAL GENERAL FUND:   $ 368,644.18

TRUST FUND:                       $   20,424.15

TOTAL:                                $389,068.33

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue a refund in the amount of $108.11 to Daniel O’Callaghan and Nicole Baron for overpayment of 2016 Taxes for the property located at 70 Lee Avenue.                                     [Section 020 / Block 01 / Lot 061]

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to engage Liberty Capital Services to serve as a Municipal Financial Advisor regarding debt issuance, as per the attached contract.               [Contract #1494]

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED that the Treasurer of the Village of Babylon be directed to hold a Tax Sale at the Municipal Building, 153 West Main Street, Babylon, New York, on Saturday, the 25th of February, 2017, at 10:00 a.m.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS, the Village Board wants to develop a balance of various retail businesses in the downtown business district, and;

WHEREAS, the Building Inspector has reported to the Board of Trustees that there are currently no less than 30 bar/restaurant-type businesses operating within the Retail Business District, and;

WHEREAS, concerns about a proliferation of bar/restaurants in the Retail Business District have been expressed to the Mayor and members of the Board of Trustees, and;

WHEREAS, the local economy will be adversely affected if a healthy balance of commercial enterprise is not maintained in the Retail Business District, and;

WHEREAS, a saturation of one particular type of commercial enterprise is contrary to the interests of maintaining a balanced local economy, and;

WHEREAS, the continued proliferation of restaurant/bar uses in the concentrated area of the Retail Business District is likely to have an adverse impact on the local economy and to be detrimental to the health, safety and general welfare of the local community, and;

WHEREAS, a concentration of such businesses in the aggregate will impact public services, traffic patterns and public parking, and code enforcement issues, and;

WHEREAS, the Board finds it necessary to review the impact that such proliferation has had and the impact that a further proliferation will or may have in order to protect and/or enhance property values and to safeguard and promote the public interest.

NOW THEREFORE, it is hereby

RESOLVED that a moratorium be imposed for a period of one year within which time the Board will not hear to determine any applications for special permission concerning a bar/restaurant, excepting therefrom locations currently having the benefits of such special permission, and it is further;

RESOLVED that during the period of moratorium the Planning Board shall be commissioned to review and study the recent proliferation of bar/restaurants and to report and make recommendations to the Board of Trustees as to the enactment of local laws and changes to existing zoning code provisions that will protect and promote the public interest, and it is further;

RESOLVED that the Planning Board is hereby authorized to issue such requisitions as the Planning Board may determine are appropriate and necessary in order to investigate and determine the consequences and effects of such proliferation and to develop plans and strategies consistent with the public interest, such requisitions to be made to the office of the Mayor, and it is further;

RESOLVED that the Mayor be authorized to direct and appropriate such resources and personnel as are available without added costs to the Village in order to collect and furnish information to the Planning Board in accordance with any such requisition, and to the extent such requisition cannot be fulfilled without expense or cost, to submit the requisition to the Board of Trustees for consideration thereof.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant a license to the following applicants to drive a taxi cab for Sunset Taxi in the Village of Babylon:

Robert Elia

Mayor Scordino made the following announcement:

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, January 16, 2017, in observance of the Martin Luther King Day Holiday.

Residents should not put rubbish or recycling out to the curb on holidays.  These items should be put out the following week on your regularly scheduled rubbish / recycling day.

The meeting was opened to the public; no one addressed the Board.
