A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, February 23rd, 2016.  On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 7:45 p.m.  On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, the meeting adjourned at 8:05 p.m.

Regular meeting of the Board of Trustees opened at 8:08 p.m.

The Pledge of Allegiance was lead by Trustee Basile.

On  the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the February 9th, 2016, regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated February 17, 2016:

At the regular monthly meeting of the Fire Council held February 16, 2016, the Fire Council took the following actions and we await your approval:

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to issue a refund in the amount indicated for the return of one Board of Trustees sign for partial refund:

WHEREAS A PUBLIC HEARING WAS HELD on Tuesday, February 9th, 2016, 

BE IT HEREBY RESOLVED to approve the application of Christina Kelly, Principal of Villa Castel Inc., to amend the Covenants & Restrictions for Babylon Crepe & Pita Grill, 122 North Carll Avenue.

ALSO BE IT RESOLVED to approve and adopt the attached Covenants and Restrictions for Babylon Crepe & Pita Grill, 122 North Carll Avenue.  (Section 9/Block 1/Lot 32)

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Girl Scouts to use the Locust Avenue Parking lot on Saturday, March 19th, 2016 (with a back-up date of Friday, March 18th), for approximately five hours, to sort and distribute Girl Scout cookies.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to approve the following warrant for February 23, 2016:

Trustee Amelia reminded everyone that the applications for summer employment are available in the Mayor’s Office.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to St. Paul’s Reformed Church to hold a dawn worship service at the Argyle Park Gazebo on Easter Sunday, March 27, 2016, at 6:30 a.m.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to increase Kristina Everitt’s Board of Appeals stipend by $500.00 effective February 23, 2016.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to change the fee schedule for Rental Housing Permits as indicated below, effective as of February 23, 2016:

$100.00 for each dwelling up to 4 units:

            1 Unit - $100.00

            2 Units- $200.00

            3 Units- $300.00

            4 Units- $400.00

$50.00 for each dwelling unit starting with the 5th unit:

            5 Units- $450.00

            6 Units- $500.00

            7 Units- $550.00…

            Etc.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Chamber of Commerce for the 2016 events (with sidewalk access) as per the attached. This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

WHEREAS a Public Hearing was held on Tuesday, February 23, 2016, be it hereby enacted the following Local Law, proposed as Local Law #1 of 2016, is HEREBY ADOPTED as:

Local Law #1 of the year 2016 authorizing a property tax levy increase in excess of the limit established in General Municipal Law § 3-C.

Local Law #3 of the year 2016, to amend current Village Code, Chapter 210, 210-1 and 210-2, pertaining to Landscapers and lawn treatment substances to be kept off sidewalks, driveways, curbs and streets.

WHEREAS a Public Hearing was held on Tuesday, February 23, 2016, be it hereby enacted the following Local Law, proposed as Local Law #4 of 2016, is HEREBY ADOPTED as:

Local Law #4 of the year 2016, to amend Chapter 295, 295-1, 295-2 and 295-3, pertaining to Hoverboards and/or any motorized personal transport device.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

BE IT HEREBY RESOLVED that the Village of Babylon approves the settlement of having its insurance carrier pay the sum of $65,000 to Eugene Racanelli, and agrees to pave the subject easement within its proper boundaries upon terms to be mutually agreed upon which will be reduced to a written settlement with survey attached.  This settlement resolves the pending lawsuit between the parties.

Mayor Scordino made the following announcement:

A Bid Opening is scheduled for Thursday, March 3rd, 2016, at 9:30 a.m. for Plastic Bags.  Bid Specifications may be examined and obtained in the Village Clerk’s office, between the hours of 9:00 a.m. and 5:00 p.m. daily, except Saturdays, Sundays, and Holidays, on and after February 18th, 2016.

The meeting was opened to the public;

Frank Curtin, 420 Fire Island Ave., asked about the resolution regarding the settlement property and about the Long Island Yacht Club property.
