A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, February 7, 2017.  On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried, the meeting opened at 4:38 p.m.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the meeting adjourned at 6:35p.m.

Regular meeting of the Board of Trustees opened at 8:00 p.m.

The Pledge of Allegiance was led by Trustee Muldowney.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the January 24th, 2017, regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Girl Scouts to use the Locust Avenue Parking lot on Saturday, March 11th, 2017 (with a back-up date of Saturday, March 18th), for approximately five hours, to sort and distribute Girl Scout cookies.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to hire Theresa Rodriguez as a part-time clerical in the Village Clerk’s office with a salary of $10.50 per hour effective January 31, 2017.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to issue a refund in the amount of $22.75 to Joan Crockett, for overpayment for copies made to fill F.O.I.L. request.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the Babylon Rotary Club to hold the Annual Dirty Sock 10K Run on Sunday, August 13th, 2017, from 8:00 am. to 11:00 am.  This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on August 9, 2016, to consider the application of Mark Perlman and Main Street Theatre Partners, LLC, to operate a theatre and performing arts center, and

WHEREAS this application was approved by resolution at the regular meeting of the Board of Trustees on September 13, 2016, subject to Covenants, Restrictions and Conditions to follow,

BE IT HEREBY RESOLVED to accept and adopt the attached Covenants, Restrictions and Conditions for Main Street Theatre and Performing Arts Center, 34 W. Main Street, Babylon, NY [SCTM #0102-014-01-011], on file with the Village Clerk. The form of such Covenants, Restrictions and Conditions are to be reviewed by the Village’s Special Counsel, Gerard Glass, prior to being filed / recorded with Suffolk County.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a refund in the amount of $10.00 to Care Landscaping for overpayment of 2017 Landscaper Permit #1006.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a refund in the amount of $10.00 to The Lawn Barber, Inc., for overpayment of 2017 Landscaper Permit #999.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon Little League to hold the Opening Day Parade at 10:00 a.m. on Saturday, April 22nd, 2017.  The parade will start from the Fire House on North Carll Avenue, head East on Main Street, turn North onto Deer Park Avenue, West onto Railroad Avenue, North onto North Carll Avenue, West onto Locust Avenue, and end at the Locust Avenue fields.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried,

BE IT RESOLVED, that the Village Board of the Village of Babylon, hereby establish standard workdays for the attached for the purpose of determining days worked reportable to the New York State and Local Employees’ Retirement System:

The required three-month calendar logs have been submitted.   Based on the calendar logs, the number of days per month to be reported is shown on the attached chart. [Deborah Basile]

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to hire Margaret O’Sullivan as a part-time code enforcement officer with a salary of $10.50 per hour effective January 17, 2017.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue a refund in the amount of $398.00, to Herman Katz Cangemi & Clyne, LLP, [attorneys for Cary Angiulo], as per the attached signed court order, for the 2013/14 taxes on 144 Annuskemunnica Rd,  Section 22  Block 2  Lot 15.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the Babylon Junior-Senior High School to use the South field on Locust Avenue [including use of the lights, press box, and concession stand] on Friday, April 28, 2017, at 7:00 p.m., to host the Sixth Annual Peter Figoski Memorial Softball Game.  This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to correct the resolution dated January 24th, 2017; and accept the Audited Financial Statements beginning June 1, 2013, through May 31, 2014, as prepared by Skinnon and Faber, CPA’s, P.C.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant a license to the following applicant(s) to drive a taxi cab for Sunset Taxi in the Village of Babylon:

The Mayor made the following announcements:

-           Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, February 20, 2017, in observance of the Presidents’ Day Holiday.

Residents should not put rubbish or recycling out to the curb on holidays.

-           Please be advised that Summer Job Applications will be available in the Mayor’s Office starting on Tuesday, February 21, 2017.  Applicants for summer jobs must be at least 16 years old.  However, applications will be accepted for residents 15 years of age, and these applications will be kept on file and only used if additional students are needed.

-           The Board of Trustees of the Village of Babylon will hold a Public Hearing at 153 West Main Street, on Tuesday, February 28, 2017, at 7:00 p.m., to consider the adoption of the following Local Laws:

Local Law #1 of the year 2017, authorizing a property tax levy increase in excess of the limit established in General Municipal Law §3-c.

Local Law #2 of the year 2017, amending current Village Code 365-12A, regarding first floor requirements.

Local Law #3 of the year 2017, pertaining to Outdoor Fire Pits and Chimineas.

Complete text of the above Local Laws will be available in the Office of the Village Clerk as of Thursday, February 16, 2017.

The meeting was opened to the public;

Joan Crockett, 162 Cadman Ave., questioned timing of audits and final outcome of calendars/charts regarding retirement reporting.
