A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, January 30, 2018.  On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried, the meeting opened at 4:11 p.m. On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, the meeting adjourned at 5:16 p.m.

Regular meeting of the Board of Trustees opened at 8:05 p.m.

The Pledge of Allegiance was led by Trustee Adams.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the January 23, 2018, regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to St. Paul’s Reformed Church to hold a dawn worship service at the Argyle Park Gazebo on Easter Sunday, April 1, 2018, at 6:30 a.m.

This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Jr.-Sr. High School to use the Park Avenue Tennis Courts (North and South side) for the Varsity, Junior Varsity, and Junior High 2018 Spring Season beginning Monday, March 5th through June 8th, 2018, from 2:30 p.m. to 5:30 p.m. [6:30 p.m. game days]. This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Jr.-Sr. High School to use the south field on Locust Avenue for Junior High Softball team practices, beginning March 26th through June 6th, 2018, from 3:00 p.m. to 5:30 p.m. This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Jr.-Sr. High School to use the South Field on Locust Avenue [including use of the lights, press box, and concession stand] on Friday, April 27, 2018, at 7:00 p.m., to host the 7th Annual Peter Figoski Memorial Softball Game.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Girl Scouts to use the Locust Avenue Parking lot for approximately five hours on Saturday, February 24th, 2018 (back-up date February 17th), to sort and distribute Girl Scout cookies.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon Community Scholarship Fund to maintain temporary signs at various merchants in the Village from April 1st to May 1st, 2018, to advertise the 53rd Annual Fashion Show & Dinner.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to Erica Zigon to hold an acoustic music charity event, “We’ve Got You Covered” this Saturday, February 17th, 2018, from 2:00 p.m. to 7:00 p.m., at Swell Taco, 135 Deer Park Avenue.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $225.00 to Russell Yates for the return of reserved parking decal #591.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the Babylon Little League to hold the Opening Day Parade at 10:00 a.m. on Saturday, April 14th, 2018.  The parade will start from the Fire House on North Carll Avenue, head East on Main Street, turn North onto Deer Park Avenue, West onto Railroad Avenue, North onto North Carll Avenue, West onto Locust Avenue, and end at the Locust Avenue fields.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to Babylon Little League to use the Locust Avenue Baseball Complex for the annual Summer Camp to be held June 25th to June 29th, 2018.  This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to remove the exemptions from the 2017 Final Roll as per the attached Assessor Petitions and bill the new owners the Exempt Property Restoration for the Tax Years as indicated on the attached chart.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the Citizens Campaign for the Environment to canvass in the Village from April 3rd to April 12th 2018, between the hours of 4:00p.m. and 8:00p.m.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to accept the attached Software License and Service Agreement with Passport Labs, Inc., which will allow for mobile payment of parking spaces in the metered commuter lots.        [#1505]

Attorney Sikowitz commented that this agreement will be financially beneficial to the Village and will save the Village thousands of dollars in computation of fees collected.

RESOLVED to grant a license to the following applicant(s) to drive a taxi cab for Lindy’s Taxi in the Village of Babylon:     William Tipley, Jr.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the resignation of Joel Sikowitz as Attorney for the Village of Babylon effective February 24, 2018.

Attorney Sikowitz addressed the Board and spoke of his 26 years with the Village of Babylon. He paid tribute to the dedicated employees, describing them as “the face of the Village”; he commended the Trustees and the Mayor for the work they have done, always for the betterment of Village residents.

The Trustees and Mayor thanked Mr. Sikowitz, for his work with the Village and for his friendship, commented on his tremendous influence on the Village, and wished him the best of luck.

Mayor Scordino made the appointment of Gerard Glass and Associates as Village Attorney pursuant to a retainer agreement on file with the Village Clerk.  The terms of said agreement provide that the fees shall be provided at a rate of $75,000.00 per year for all included services and a rate of $300.00 per hour for all excluded services.             [#1504]

RESOLVED to confirm the Mayor’s Appointment of Gerard Glass and Associates as Village Attorney.

*Trustee Adams abstained from voting; in the interest of full transparency, she stated that Gerard Glass has ownership of the building in which she is a tenant.

Attorney Sikowitz commended this appointment and spoke of the good character and reputation of Attorney Gerard Glass.

RESOLVED to transfer expenditure lines in the 2017/18 Budget as indicated:

Mayor Scordino made the following announcements:

  • Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, February 19th, 2018, in observance of the President’s Day Holiday.  Residents should not put rubbish or recycling out to the curb on holidays.
  • Please be advised that Summer Job Applications will be available in the Mayor’s Office starting Tuesday, February 20th, 2018.  Applicants for summer jobs must be at least 16 years old.  However, applications will be accepted for residents 15 years of age, and these applications will be kept on file and only used if additional students are needed.
  • Grievance Day will be held in the Upstairs Conference Room of the Municipal Building, 153 W. Main Street, on Tuesday, February 20th, 2018, from 1:00 p.m.– 5:00 p.m. and 6:00 pm.– 8:00 p.m.; it will also be held on Tuesday, March 6th, 2018 from 1:00 p.m.– 5:00 p.m.
  • The Board of Trustees of the Village of Babylon will hold a Public Hearing on Tuesday, February 27, 2018, at 7:00 p.m. to consider the following:

-          Proposed Local Law # 1 of 2018 (pertaining to a property tax levy in excess of the limit established in General   Municipal Law 3-C)

-        Application of Brooke Jankow, Principal of Brooke & Steven Restaurants, Inc., to expand the restaurant, Swell Taco, located at 135 Deer Park Ave.

The meeting was opened to the public:

Frank Curtin, 420 Fire Island Avenue, commented on the resignation of Joel Sikowitz and wished him the best of luck.

Mayor Scordino commended and thanked Village Employee, Dante Giovanniello, for his tremendous contribution that led to the identification of the person responsible for tagging graffiti on approximately 30 locations in the Village on February 8th
