A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, February 12, 2019.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 7:40 p.m.  On the motion of Trustee Adams, seconded by Trustee Silvestri and unanimously carried the meeting adjourned at 8:06 p.m.

Regular meeting of the Board of Trustees opened at 8:08 p.m.

The Pledge of Allegiance was led by Trustee Muldowney.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the January 22, 2019 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to Babylon Village Arts Council to use Argyle Park, East of the Memorial Garden, on May 18th, 2019, from 10:00 a.m. to 4:30 p.m., (rain date May 19, 2019) for the 12th Annual Outdoor Art Exhibit.

This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Jr.-Sr. High School to use the Park Avenue Tennis Courts (North and South side) for the Varsity, Junior Varsity, and Junior High 2019 Spring Season beginning Monday, March 4th through May 31st, 2019, from 2:30 p.m. to 6:30 p.m.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Girl Scouts to use the Locust Avenue Parking lot for approximately five hours on Saturday, February 23rd, 2019, to sort and distribute Girl Scout cookies.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to add a Summer Art Program to the 2019 Summer Recreation Programs offered.

Trustee Adams thanked the Mayor and the Board for adding this 5th program and explained that the Summer Art Program will be led by a Girl Scout who is working towards her Gold Award.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Chamber of Commerce to hold three Block Parties on the following evenings:

                        Thursday, June 13, 2019

                        Thursday, July 18, 2019

                        Thursday, August 29, 2019

These events will be held from 5:00 p.m. to 9:00 p.m. and will involve the following street closures:  Deer Park Avenue from Railroad Avenue to Main Street, and Fire Island Avenue from Main Street to the South entrance of the Carriage House parking lot.  The Chamber shall comply with its submissions to the Board which forms the basis for this approval. This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as signed & notarized ‘Hold Harmless’ Agreements from the Chamber of Commerce and any vendors that participate. 

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the ‘Save the Great South Bay’ Non-profit organization to hold its “Creek Defender Program” on Saturday, April 13th, 2019, from 12:00 Noon to 3:00 p.m. in Babylon Village, on the North side of Park Avenue, just east of the Carlls Creek by the tennis courts.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed an ‘Additional Insured’, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the residents of Edward Avenue to hold a Graduation Block Party on Saturday, June 29th, 2019, from 1:00 p.m. to 11:00 p.m. The street will be blocked between #28 Edward Avenue and #20 Edward Avenue, subject to parking restrictions for emergency purposes.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to remove the exemption as per the attached Assessor Petition and bill the new owners the Exempt Property Restoration for the Tax Year as indicated on the attached chart.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, February 12, 2019,

BE IT HEREBY RESOLVED to approve the application of Jason Lee, of Long Island Pekin, to open a restaurant at 96 East Main Street, the former location of N’Joy.

ALSO BE IT RESOLVED to approve and adopt the attached Covenants and Restrictions for Long Island Pekin, 96 East Main Street.                            [Section 014 / Block 02 / Lot 012]

Trustee Silvestri thanked Trustee Adams for adding the Summer Art Program and commented that the Conklin House is working with the Babylon Village Arts Council on several upcoming events.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to accept the resignation of Charles Ferris as a Highway Laborer effective January 19, 2019.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the Babylon Jr.-Sr. High School to use the South Field on Locust Avenue [including use of the lights, press box, and concession stand] on Friday, May 3rd, 2019, at 4:30 p.m., to host the 9th Annual Peter Figoski Memorial Softball Game.

This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to St. Joseph’s Church to hold a ‘LIVE STATIONS OF THE CROSS’ on Good Friday, April 19, 2019, from 1:15 p.m. to approximately 3:00 p.m.

This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to Deborah Kolovich to maintain 18” x 24” temporary signs at various homes in the Village from February 24, 2019 to March 19, 2019, regarding the upcoming Village Election on March 19, 2019.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to Deborah Kolovich to maintain 8 ½” x 11” temporary signs at various businesses in the Village from February 24, 2019 to March 19, 2019, regarding the upcoming Village Election on March 19, 2019.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the resignation of Jaime Cruz as a Golf Course laborer effective December 12, 2018.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to the Citizens Campaign for the Environment to canvass in the Village for a three-week period between February 14th through March 30th, 2019, Monday through Friday, between the hours of 4:00p.m. and 8:00p.m.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to increase the fee for electric use at Village Marinas to $100, effective as of the 2019 Boating Season.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to the Babylon Jr.-Sr. High School to use the Softball field on the north side of Locust Avenue for Junior High Softball team practices, beginning March 25th through May 28th, 2019, from 3:00 p.m. to 5:30 p.m.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to the Better Babylon Party to maintain 24” x 36” temporary signs at various addresses in the Village from February 21, 2019 to March 21, 2019, regarding the upcoming Village Election on March 19, 2019.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to schedule a Public Hearing to be held at 7:00 p.m. on Tuesday, February 26th, 2019 to consider the adoption of Local Law 3 of 2019, a Local Law to amend Chapter 336, Trees, by deleting Article II and adding new Sections 336-1 through 336-7.  Complete text of this proposed Local Law will be available in the Office of the Village Clerk and on our website beginning February 14, 2019.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to schedule a Public Hearing to be held at 7:00 p.m. on Tuesday, February 26th, 2019 to consider the adoption of Local Law 4 of 2019, a Local Law authorizing a property tax levy increase in excess of the limit established in General Municipal Law §3-c.  Complete text of this proposed Local Law will be available in the Office of the Village Clerk and on our website beginning February 14, 2019.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant a license to the following applicants to drive a taxi cab for Lindy’s Taxi in the Village of Babylon:   Theodore Sienkiewicz  

Mayor Scordino made the following announcements:

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, February 18th, 2019, in observance of the President’s Day Holiday.  Residents should not put rubbish or recycling out to the curb on holidays.

Please be advised that Summer Job Applications will be available in the Mayor’s Office starting Tuesday, February 19th, 2019.  Applicants for summer jobs must be at least 16 years old.  However, applications will be accepted for residents 15 years of age, and these applications will be kept on file and only used if additional students are needed.

Grievance Day will be held in the Upstairs Conference Room of the Municipal Building, 153 W. Main Street, on Tuesday, February 19th, 2019, from 3:00 p.m.– 7:00 p.m.
