REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON WAS HELD IN THE UPSTAIRS CONFERENCE ROOM,

153 WEST MAIN STREET, BABYLON, NEW YORK,

ON WEDNESDAY,

DECEMBER 13, 2017

Regular meeting of the Board of Trustees opened at 8:08 p.m.

The Pledge of Allegiance was led by Trustee Adams.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the November 28th, 2017, regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant the application of Thomas DelFranceso of T.D. Vending Corporation to operate a Mister Softee Ice Cream Truck in the Village of Babylon for the 2018 season.

This permission is granted contingent upon timely receipt of required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried,

BE IT HEREBY RESOLVED that the Village of Babylon accept the transfer of ownership of a strip of real estate [on Peninsula Drive] identified as Tax Map District 102/ Section 13/ Block 1/ Lot 47 from A.J. Properties, prior owner, effective November 9, 2017.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried,

BE IT HEREBY RESOLVED that the Village of Babylon enter into a contract with Property Registration Champions Corporation to provide services regarding Mortgage Default, Vacant and Rental Properties within the Village of Babylon.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to St. Nicholas Greek Orthodox Church to use Argyle Park at 12:00 Noon on Sunday, January 7th, 2018, for the annual Blessing of the Waters.

This permission is granted contingent upon timely receipt of required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to issue refunds in the amounts indicated below to each of the applicants listed for the return of ZBA sign(s) for partial refund:

RESOLVED to approve the following warrant for December 13th, 2017:

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to amend the total seating on the Covenants and Restrictions dated November 28, 2017 for Swell Taco, 135 Deer Park Avenue, as per the attached.        [Section 10/ Block 4/ Lot 4]

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried,

WHEREAS, the Village of Babylon did establish a Deferred Compensation Plan for employees; and

WHEREAS, the Deferred Compensation Committee did accept and review proposals for the administration of the Deferred Compensation Plan for a (5) five-year renewal contract period as stipulated in Section 9003.1; and

WHEREAS, after publishing in the New York State Register, the Deferred Compensation Committee does recommend the award of such contract to the current providers administering the Village’s plan; and

WHEREAS, the Deferred Compensation Committee does recommend Nationwide, as Administrative Services Agency with Nationwide Trust Company, as trustee;

now, therefore,

BE IT RESOLVED, that the Mayor of the Village of Babylon hereby is directed to execute all necessary documents to contract Nationwide and the Nationwide Trust Company, for administrative, financial, and trustee services for the Village of Babylon Deferred Compensation Plan for the next (5) five years.

Trustee Muldowney announced that the Golf Course officially closed for the season last Tuesday.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the attached contract with Traditional Air for air conditioning and heating system service.                                                                                [Contract #1430]

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the attached Inter-Municipal Cooperation Agreement establishing SuffolkShare.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS the Village Board enacted a Restaurant Moratorium ending December 31, 2017, and,

WHEREAS the development of the Business District requires additional input regarding diversity of businesses;

NOW THEREFORE BE IT RESOLVED that the aforesaid Restaurant Moratorium be extended through December 31, 2018, with the exception of any existing structure that was a restaurant prior to January, 2017, and

RESOLVED that all other conditions recited in the January 2017 Moratorium are hereby adopted and ratified as if fully set forth herein.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS A Public Hearing was held on Tuesday, September 12, 2017,

BE IT HEREBY RESOLVED to approve the application of Conor Hartnett for changes made to the outdoor area of Mary Carroll’s, 121 Deer Park Ave. [Section 010 / Block 04 / Lot 005].

ALSO RESOLVED to accept and adopt the attached Covenants & Restrictions for Mary Carroll’s, 121 Deer Park Avenue, as per the attached.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant a license to the following applicant to drive a taxi cab for Lindy’s Taxi in the Village of Babylon:            Anthony Raia           

Mayor Scordino made the following announcements:

-        Village of Babylon offices will be closed and there will be no rubbish or garbage pick-up on Monday, December 25, 2017, and Monday, January 1, 2018, in observance of the Christmas and New Year’s Day Holidays.  There will be a special pick up of holiday wrappings, etc., no recycling or large items, on Tuesday, December 26th for those regularly scheduled for Monday rubbish pick up. Residents should not put rubbish or recycling out to the curb on Holidays.

-          There will be no second board meeting in December.

-      The Board of Trustees of the Village of Babylon will hold a Public Hearing on Tuesday, January 9, 2018, at 7:00 p.m. to consider the application of Ou Shan Lin to open N’Joy, an Asian Fusion Restaurant, at 96 East Main Street, the former location of Tokyo Restaurant.  Copy of application and plans may be examined at the Office of the Village Clerk, Monday through Friday, between the hours of 10:00 a.m. and 4:00 p.m.

The meeting was opened to the public;

Joanne Curtin, 420 Fire Island Avenue; inquired about whether the old Red Lion Building was on the National Registry, and about the silent auction being held

The Mayor wished everyone Happy Holidays and a Happy, Healthy New Year.
