A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, December 11, 2018. On the motion of Trustee Silvestri, seconded by Trustee Adams and unanimously carried, the meeting opened at 7:30 p.m.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried the meeting adjourned at 7:59 p.m.

REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON WAS HELD IN THE BOARD ROOM,

Regular meeting of the Board of Trustees opened at 8:04 p.m.

The Pledge of Allegiance was led by Trustee Muldowney.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the November 27th, 2018 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the Babylon Little League to hold the annual Opening Day Parade on Saturday, April 6th, 2019, starting at 10:00 a.m. The parade will start at the Fire House on North Carll Avenue, head east on Main Street, north onto Deer Park Avenue, west onto Railroad Avenue, north onto North Carll Avenue, west onto Locust Avenue, and end at the Locust Avenue field complex.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.    

ALSO RESOLVED to grant permission to the Babylon Little League to use a section of the Locust Avenue parking lot as a ‘family friendly area’, for hot dogs, cotton candy, popcorn, a bounce house and face painting.  This area would be open after the ceremonies, from approximately 12:00 Noon to 3:00 p.m. This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED, in accordance with the Declared Surplus and Service Road Program, a portion of the following service road is conveyed to the adjacent property owner for the sum of $50.00 plus the Village’s cost of preparing the transfer documents:

Part of (Service Road) Section 002 / Block 01 / Lot 148.10, dimensions approximately 7’ x 50’,

            adjoining 281 Litchfield Avenue [002–01–066] owned by Thomas & Lea Berman

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the Long Island Yacht Club* to erect a seasonal tent for various events held at the Yacht Club.  The size of the tent is not to exceed the 35’ wide x 75’ long concrete pad.

*This permission is granted contingent upon the Long Island Yacht club acquiring the proper tent permit from the Building Department, to expire December 31, 2019, at a fee of $100.00.

Board of Trustee approval is required for all renewal permits.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant the application of Thomas DelFranceso of T.D. Vending Corporation to operate a Mister Softee Ice Cream Truck in the Village of Babylon for the 2019 season.  This permission is granted contingent upon timely receipt of required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

Trustee Adams announced that this Friday evening from 5:00 p.m. to 9:00 p.m. is the Chamber of Commerce Dickens Wonderland.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED to grant permission to St. Nicholas Greek Orthodox Church to use Argyle Park at 12:00 Noon on Sunday, January 6th, 2019, for the annual Blessing of the Waters.

This permission is granted contingent upon timely receipt of required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED to re-appoint Nancy Iglesia-Gillen to the Architectural Review Board for a three-year term which will be January of 2022.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law #6 of 2018, pertaining to establishing a moratorium on new applications for subdivision in the A-11 residential zoning districts in the Village of Babylon,

and therefore,

BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried it was

RESOLVED to accept the attached agreement with All Shore Marine Construction for ice breaking services for the 2018/19 winter season.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried it was

RESOLVED to issue a refund in the amount of $100.00 to Christopher Paulicelli of 101 Deer Park Ave. LLC for the return of two Board of Trustees Public Hearing signs for partial refund.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried it was

RESOLVED to grant an annual stipend of $4,160.00 to Margaret O’Sullivan to provide EMT services in addition to her Code Enforcement duties, effective December 11, 2018.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried it was

RESOLVED to increase the annual stipend to Alex Weber to provide EMT services in addition to his Code Enforcement duties to $6,240.00, effective December 11, 2018.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to schedule a Public Hearing to be held at 7:00 p.m. on Tuesday, January 8th, 2019 to consider the adoption of Local Law 1 of 2019, a Local Law to amend Chapter 122 Article II, by adding 122-8 (F.) Mooring and Anchoring and 122-8 (G.) Removal of dangerous, unseaworthy, and disabled vessels.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, December 11th, 2018,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law #6 of 2018, is HEREBY ADOPTED as:

Local Law 6 of 2018, establishing a moratorium on new applications for subdivision in the A-11 residential zoning districts in the Village of Babylon.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant a license to the following applicants to drive a taxi cab for Lindy’s Taxi in the Village of Babylon:     Robert Donnelly

Mayor Scordino made the following announcements:

There will be no second Board Meeting in December.

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Tuesday, December 25, 2018 and Tuesday, January 1, 2019 in observance of the Christmas and New Year’s Day holidays.  There will be a special pick up of holiday wrappings, etc., no recycling or large items, on Wednesday, December 26th for those regularly scheduled for Tuesday rubbish pickup.  Residents should not put rubbish or recycling out to the curb on holidays.

Mayor Scordino wished Happy Holidays to all.
