A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, December 10, 2013.  On the motion of Trustee Muldowney, seconded by Trustee Amelia and unanimously carried, the meeting was opened at 7:04 p.m. On the motion of Trustee Muldowney, seconded by Trustee Amelia and unanimously carried, the meeting was adjourned at 7:40 p.m.

Regular meeting of the Board of Trustees opened at 8:00 p.m.

The Pledge of Allegiance was lead by Trustee Davida.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the November 26, 2013 regular meeting of the Board of Trustees and dispense with reading of the same.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to hire Kevin Hebel as a Highway Laborer with an annual salary of $20,800 effective November 25, 2013.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to approve the attached change order from Constar, Inc. regarding the Lewis Pond / Boynes Canal Bulkhead and Site Improvements.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to increase the boat berth fees by $5 per foot for the 2014 season for the following marinas:

Lewis Pond

Boynes Canal

Southeast Lewis Pond

Northeast Lewis Pond

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue refunds in the amount of $25 to each of the applicants listed below for the return of one (1) ZBA sign for partial refund:

RESOLVED to grant the application of Thomas DelFranceso of T.D. Vending Corporation to operate a Mister Softee Ice Cream truck in the Village of Babylon for the 2014 season.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue refunds in the amount of $70 to each of the residents listed below for changing from ‘Reserved’ parking decals to ‘Occasional Use’ parking decals:

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue refund in the amount of $25 to Micheline Cummings for the return of one (1) Board of Trustees sign for partial refund for the property located at 450 Fire Island Avenue.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to re-appoint Theresa Bunger to the Architectural Review Board for a three (3) year term which will expire November of 2016.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to increase the annual salary of Philip Brown $1000 effective November 28, 2013, having completed his six month probationary period.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to grant permission to St. Nicholas Greek Orthodox Church to use Argyle Park for the annual Blessing of the Waters on Sunday, January 12, 2014, at 12:00 noon.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve and grant license to the following applicant to drive a taxi cab for Sunset Taxi in the Village of Babylon:       Daniel Morales

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON, IN THE COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS:

Section 1.  Revenue Anticipation Notes (herein called the “Notes”) of the Village of Babylon, in the County of Suffolk, New York (herein called the “Village”), in the aggregate principal amount of not to exceed $2,000,000, and any notes in renewal thereof, are hereby authorized to be issued pursuant to the provisions of Sections 25.00 and 39.00 of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called the “Law”).

 Section 2.  The Notes are authorized to be issued in anticipation of the receipt moneys expected to be received by the Village from the United States of America acting through the Federal Emergency Management Administration (FEMA) on account of recent storm-related damage, and the proceeds of the Notes shall be used only for the purposes of paying the expenses of the Village, or reimbursing the Village for any such expenses paid, on account of such storm-related damage and related costs.

 Section 3.  The following additional matters are hereby determined and declared:

(a)  The Notes are not issued in renewal of other notes.

(b)  The Notes shall mature within the period of one year from the date of their issuance.

(c)  No revenue anticipation notes have been heretofore issued in anticipation of the revenues specified in Section 2 hereof.

(d)  The Notes are issued in anticipation of the collection of revenues other than real estate taxes or assessments.

(e)  As of the date hereof, the revenues described in paragraph 2 hereof are uncollected.

Section 4.  The Notes hereby authorized shall contain the recital of validity prescribed by Section 52.00 of the Law and shall be general obligations of the Village.  The faith and credit of the Village are hereby pledged to the punctual payment of the principal of and interest on the Notes and unless the Notes are otherwise paid or payment provided for, an amount sufficient for such payment shall be inserted in the budget of the Village and a tax sufficient to provide for the payment thereof shall be levied and collected.

Section 5.  Subject to the provisions of this resolution and the Law, and pursuant to Section 50.00 and Sections 56.00 to 61.00 of the Law, the power to sell and issue the Notes authorized pursuant hereto, and any renewals thereof, and to determine the terms, form and contents, including the manner of execution, of such Notes, and to execute arbitrage certifications relative thereto, is hereby delegated to the Village Treasurer, the chief fiscal officer of the Village.

Section 6.   The Notes shall be executed in the name of the Village by the manual signature of the Village Treasurer, the Village Clerk, or such other officer of the Village as shall be designated by the chief fiscal officer of the Village, and shall have the corporate seal of the Village impressed or imprinted thereon, which corporate seal may be attested by the manual signature of the Village Clerk.

Section 7.   This resolution shall take effect immediately.

Mayor Scordino made the following announcements:

There will be no second Board meeting in December.

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Wednesday, December 25, 2013, in observance of the Christmas Day Holiday and on Wednesday, January 1, 2014, in observance of the New Years Holiday.  There will be a special pickup on Thursday, December 26th, 2013, for those on the regular Wednesday rubbish route, of holiday wrappings etc., no recycling or large items.  Residents should not put rubbish or recycling out to the curb on holidays.  These items should be put out the following week on your regular scheduled rubbish/recycling day.

Local merchants reported that ‘Small Business Saturday’ was successful.  We are hoping for the same support of our local businesses this Friday, December 13, 2013, for the Old Fashioned Christmas Event.

On behalf of the Mayor and the Board of Trustees, the Mayor wished everyone a Merry Christmas and Happy, Healthy New Year.
