REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON WAS HELD IN THE BOARDROOM 153 WEST MAIN STREET TUESDAY MARCH 27, 2012 AT 8:00 P.M.

 

PRESENT: Mayor Ralph Scordino

Trustee: Kevin Muldowney

Trustee: Alice Vanderveldt

Trustee: Debbie Basile

Trustee: Tony Davida

Attorney: Joel Sikowitz

 

 

On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried

 

The work session opened at 7:50 p.m.

 

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried

 

The work session adjourned at 8:22 p.m.

 

Regular meeting was opened at 8:25 p.m.

 

The Pledge of Allegiance was lead by Trustee Basile

 

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

 

RESOLVED TO: approve the minutes of the previous meeting and dispense with the reading of the same.

 

On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 

RESOLVED TO: approve the following actions taken at the Fire Council meeting on March 20, 2012.  Added Donald J. Doukas to the Driver’s List of Unit 1-2-10.  Took Jason Witthohn of the Argyle Hose off sick leave as of February 20, 2012 with medical clearance.  Placed Alfred Foote of the Hook & Ladder on sick leave as of March 13.

Accepted Elizabeth Santos as a Probationary FFE Member of the Rescue Squad.  Accepted the resignation of Candice O’Connell of the Hook & Ladder Department as of March 13, 2012.

 

On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried

 

WHEREAS A Public Hearing was held on Tuesday, December 13, 2012

 

BE IT HEREBY RESOLVED TO: approve the application of Jordan Eddi to open a

Yogurt Shop at 80 A West Main St. Babylon.  This approval is subject to Covenants and Restrictions to be prepared by the Village Attorney and executed by the applicant.

 

On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 

RESOLVED TO: grant permission to the Babylon Village Chamber of Commerce to hold the following events:

Spring Fling – Arts & Music Festival and Sidewalk Sale

Friday, Saturday & Sunday – June 1, 2, &  3

Friday & Saturday 10 a.m. to 7 p.m.

Sunday – Noon - 5 p.m.

(rain dates June 8, 9, &10)

 

Fall Harvest Street Fair

Saturday, October 20, 10 a.m.  – 6 p.m.

(rain date – October 27)

 

Old Fashioned Village Christmas

Friday, November 30 5 p.m. – 9 p.m.

(rain date – Dec. 7)

 

On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 

RESOLVED TO: accept the Assessor’s Petition attached for decrease in assessed value on the following property:

Section  22  Block  03  Lot  018  56 Yacht Club Rd.

 

On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 

RESOLVED TO: approve the following warrant for March 27, 2012

General Account:

$ 51,280.01

Golf Course Account:

$   2,369.09

Total General Fund:

$ 53,649.10

Trust Fund:

$   3,337.64

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried

 

RESOLVED, IN ACCORDANCE with the Service Road Program a portion of the following service road is conveyed to the adjacent property owner:

Part of Section  5  Block  2  Lot  136.17 121 Litchfield Ave.

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

 

RESOLVED TO; grant permission to Suffolk Marine Inc. to use the Village Municipal Dock for the Striped Bass Tournament to be held on Sunday, June 3, 2012.

 

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried

 

WHEREAS A Public Hearing was held on Tuesday, February 14, 2012 for Molto Vino 45 Deer Park Ave.

 

BE IT: hereby resolved to adopt the covenants and restrictions determined by the Village Attorney.

 

On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried it was

 

RESOLVED TO: grant permission to the Babylon American Legion to hold the annual Memorial Day parade on Monday, May 28, 2012.  The parade will start at 10 a.m. at Foster Blvd. and Deer Park Ave.  The parade will proceed south on Deer Park Ave. to Montauk Hwy. then west to the Gazebo where they will hold the annual Memorial
Day ceremonies.

 

On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried it was

 

RESOLVED TO: accept the Assessor’s Petition attached for decrease in assessed value on the following property

Section  17  Block  02  Lot 073  30 Kittiwake Lane

 

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried

 

BE IT HEREBY RESOLVED by the Mayor and Trustees of the Village of Babylon that the Village of Babylon settle the Federal Landfill Litigation by the payment of $15,000.00 through our special counsel, Robert Folks, to the Joint Defense Group.

 

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

 

RESOLVED TO: grant permission to David R. Scharf to hold a From the Heart Day.  This day is designed to provide free dental care to individuals in need who cannot otherwise access dental care.  See attached.

 

Mayor Scordino announced that

The Budget for the 2012-2013 fiscal year was received by the Village Clerk from the Village Treasurer on March 20, 2012, and has been presented to the Board by the Village Clerk.

 

Please Take Notice the Annual Budget Hearing will be held o Monday, April 2, 2012 at 7:00 p.m. where comments relating to the tentative budget will be heard. 

Immediately following the Budget Hearing, the annual Organizational Meeting will be held.

 

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

 

RESOLVED TO: approve the following applicant a license to drive a taxi cab in the Village of Babylon for Lindy’s

Kevin Thomas

 

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously

carried it was

 

RESOLVED TO: deny the following applicant a license to drive a taxi cab in the Village of Babylon for Lindy’s

Vincent Mirasoli

 

Mayor Scordino announced that there will be (2) two Public Hearings on Tuesday, April 10, 2012 at 7:00 p.m.

 

Village of Babylon Offices will be closed at 12:00 noon Friday, April 6, 2012, in observance of Good Friday.

 

Meeting was opened to the Public.
