A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, August 13, 2019.  On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 8:10 p.m. On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried, the meeting adjourned at 8:35 p.m.

Regular meeting of the Board of Trustees opened at 8:36 p.m.

The Pledge of Allegiance was led by Trustee Davida.

Mayor Scordino began the meeting by acknowledging the Fire Chiefs present in the audience: Chief Golub, First Assistant Chief Joseph Fraccalvieri, Second Assistant Chief Matthew Arundale, and Third Assistant Chief James Miga.  He then asked Alex Webber, Robert Carlock, Ryan McKeown, and William Bender III (absent), all members of the Babylon Fire Department, to approach the Board.  The Mayor read a letter of commendation to each one of them for their service to the Babylon Fire Department and for their exemplary training, dedication and efforts when responding to a rescue call on June 21, 2019.  Due in part to their quick assessment of the condition of a resident in need and the life-saving treatment they provided, that person is progressing in their recovery. The Mayor expressed his gratitude.

On behalf of the Board of Trustees, Trustee Adams acknowledged and thanked Katie Gennings for her contribution to this year’s summer recreation programs with her ‘Art Monsters’ program.  This outstanding and fun program helped students to focus on many different facets and perspectives of art and was a very welcome new addition. Trustee Adams explained that this program was created as Katie’s Girl Scout Gold Award project; the Board looks forward to presenting Katie with a much-deserved proclamation at her Gold Award Ceremony.  Katie talked about her experience with ‘Art Monsters’ and presented the Mayor with some of her original artwork.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to amend the refund resolution dated July 23, 2019 and re-issue a refund in the amount of $150.00 to The Green Fork Babylon, LLC regarding the Public Hearing on July 9, 2019 for 101 Deer Park Ave.  (Original resolution issued the refund to Kristy Furci; check #43080 returned and voided.)

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to approve the attached Budget Transfers for the 2018/19 Fiscal Year.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $255.00 to Michael Sasuk for giving up his boat slip #99 at East Creek.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the residents of Roosevelt Street to hold a Block Party on Saturday, September 7, 2019, from Noon to 11:00 p.m., with a rain date of Saturday, September 14th. The street will be blocked between Siegel Boulevard and Deer Park Avenue, subject to parking restrictions for emergency purposes.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the residents of Cadman Avenue to hold a Block Party on Saturday, August 24th, 2019, from Noon to 11:00 p.m. The street will be blocked between Locust Avenue and Park Avenue, subject to parking restrictions for emergency purposes.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to increase the annual salary of Jonathan Dixon $1,000.00 effective July 28, 2019, having completed his six-month probationary period.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to renew the intermunicipal agreement for Social Media Services between the Village of Babylon and the Town of Babylon until May of 2020.                                  [#1498]

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the residents of Tompkins Avenue to hold a Block Party on Saturday, September 21, 2019, from Noon to 10:30 p.m., with a rain date of Sunday, September 22nd. The street will be blocked between Little East Neck Road South and #48 & #47 Tompkins Avenue, just east of Mayhew Avenue, subject to parking restrictions for emergency purposes.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $385.00 to Charles Swensen for subletting his boat slip #19 at Lewis Pond for the remainder of the 2019 season.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to authorize the Mayor to execute a Bike Share Agreement with Zagster on terms acceptable to the Village of Babylon.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to have Alicia Lampasso-Dillon teach a lifeguarding course at the Gilbert C. Hanse Municipal Pool.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to terminate the employment of Kenneth Watson as a Highway Laborer effective July 26, 2019.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the residents of Morrison Street to hold a Block Party on Saturday, August 31, 2019, from 2:00 p.m. to 10:00 p.m., with a rain date of Sunday, September 1st, contingent upon approval from the Town of Babylon.  The street will be blocked between Livingston Avenue and Park Way, subject to parking restrictions for emergency purposes.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the Chamber of Commerce to use the Conklin House lawn during the 2019 Block Parties.  This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured” as well as a signed and notarized Hold Harmless agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED that the Mayor and Board of Trustees of the Village of Babylon hereby authorize and direct the Babylon Village Justice Court to apply for a JCAP grant in the 2019-2020 grant cycle, and upon approval of said request to enter into and execute a project agreement with the New York State Unified Court System for such financial assistance to this court.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to remove the exemptions as per the attached Assessor Petitions and bill the new owner(s) the Exempt Property Restoration for the Tax Year as indicated on the attached chart.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED that the Village of Babylon will hold the annual S.T.O.P. (Stop Throwing Out Pollutants) and Shred Day on Saturday, September 21, 2019, from 9:00 AM to Noon, with a paper shredding truck available to Village residents from 1:00 to 5:00 PM.

Trustee Davida commented that on August 25th from 7:30 p.m. to 9:30 p.m. there will be music down at the pool; there is a $5 admission fee and the Molto Vino concession will be open for food and drinks.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to increase the annual salary of Golf Course Laborer Joseph Mantesta $1,000.00 effective August 13, 2019.

RESOLVED to grant permission to the residents of Ketewamoke Avenue to hold a Block Party on Saturday, September 14th, 2019, from 3:00 p.m. to 11:00 p.m. The street will be blocked between Deer Park Avenue and Wampum Road, subject to parking restrictions for emergency purposes.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to the Babylon Tuna Club to hold the Annual Snapper Derby Clinic at the Village docks on Saturday, August 17th, 2019 from 9:00 a.m. to 12:00 Noon. This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured” as well as a signed and notarized Hold Harmless agreement.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to the West Babylon School District to use the Sumpwams Creek Golf Course for the JV Boys’ Golf Team practices and games in the Fall of 2019 and the Varsity Girls’ Golf Team practices and games in the Spring of 2020, from 3:00 p.m. to 5:00 p.m. daily. This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the restricted donation of $500 for the restoration of the Argyle Falls [from Rudy and Viola Chung].

Mayor Scordino made the following announcements:

-          There is no second Board meeting in August.

-          Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, September 2, 2019 in observance of the Labor Day Holiday.

Residents should not put rubbish or recycling out to the curb on holidays.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law #6 of 2019, pertaining to Chapter 93, Bicycles;

and therefore,

BE IT RESOLVED that the Board of Trustees has determined that this action will not have an adverse impact on the environment.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, August 13, 2019,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 6 of 2019, is HEREBY ADOPTED as:

BE IT HEREBY RESOLVED to approve the application of Frank Bono, of OG Ramen, to open a Ramen Noodle restaurant at 14-A Railroad Avenue, subject to Covenants and Restrictions to follow.

The meeting was opened to the public; no one addressed the Board.

The meeting adjourned at 9:03 p.m.
