A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, July 30, 2013.  On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried, the meeting was opened at 4:30 p.m. On the motion of Trustee Amelia, seconded by Trustee Basile and unanimously carried, the meeting was adjourned at 5:35 p.m.

A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, August 6, 2013.  On the motion of Trustee Muldowney, seconded by Trustee Amelia and unanimously carried, the meeting was opened at 4:50 p.m. On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, the meeting adjourned at 5:45 p.m.

 Regular meeting of the Board of Trustees opened at 8:03 p.m.

 The Pledge of Allegiance was lead by Trustee Amelia.

 On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

 RESOLVED to approve the minutes of the July 23, 2013 regular meeting of the Board of Trustees and dispense with reading of the same.

The Village Clerk read the letter from the Fire Department:

At the regular monthly meeting of the Fire Council held July 16, 2013, the Fire Council took the following actions and we await your approval:

Took Terrance Sicignano of the Electric Hose off sick leave as of June 14, 2013 with medical clearance.

Took Richard Oehrlein of the Electric Hose off sick leave as of July 16, 2013 with medical clearance.

Took Barbara Maier of the Argyle Hose off sick leave as of July 14, 2013 with medical clearance.

Placed Charles Schmidt of the Electric Hose on sick leave as of July 12, 2013.

 

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to decrease the assessment on the 2013 tax roll as per the attached Assessor’s Petition for 21 Cameron Avenue, Section 9, Block 2, Lot 7, and issue refund in the amount of $49.84 to Stephen Shea, 21 Cameron Avenue, for the difference in assessment for the 2013 tax year.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Women’s Club to hold the 22nd Annual Post Office Café 5K Run/Walk for MPS on the morning of Saturday, October 19, 2013.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the residents of Lewis Circle to hold a Block Party on Saturday, August 17th, 2013, from 11:00 a.m. to 11:00 p.m.  The street will be blocked between the North Side of Lewis Circle and Fire Island Avenue, subject to parking restrictions for emergency purposes.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue refund totaling $3,000 as per the attached stipulation, on

Section 12    Block 2    Lot 27.2

Payments to be made as follows:

$1,500 on or before August 31, 2013

$1,500 on or before November 30, 2013

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to change Rachel Scelfo’s position on the Zoning Board of Appeals from Alternate Board Member to Permanent Board Member, expiring April, 2014.  She will be replacing James Brucia, who resigned as a permanent member.

Trustee Basile announced that the Conklin House will be honoring the Babylon Village Fire Department with their Annual Award for Volunteerism on Sunday, September 29, 2013, from 3:00 p.m. to 6:00 p.m. at the American Legion Hall.  Admission is $20.00; Fire Department Members are admitted free.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to approve the following warrant for August 13, 2013:

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to enter into agreement with Morewood Oaks Management Associates, LLC, to audit providers of telecommunications services and utility companies and cable companies who provide services within Babylon Village boundaries and recover tax revenues due to billing errors and omissions.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried

WHEREAS A PUBLIC HEARING was held on Tuesday, July 23, 2013,

BE IT HEREBY RESOLVED to approve the application of Massimiliano Gargiulo of Molto Vino, to expand his restaurant and wine bar at 43 and 45 Deer Park Avenue, Babylon, NY.

ALSO BE IT HEREBY RESOLVED to approve and adopt the attached Covenants and Restrictions for Molto Vino as of August 2013.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the residents of Strong Avenue to hold a Block Party on Saturday, September 7th, 2013, from 11:00a.m. to 11:00p.m., with a rain date of Sunday, September 8th, 2013.  The street will be blocked between Siegel Blvd. and Deer Park Avenue, subject to parking restrictions for emergency purposes.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue refund in the amount of $270.00 to Richard Pulaski, as he switched his boat berth from #38 at Argyle Basin to a smaller berth, #4 at Lighthouse Canal.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to increase the salary of Jeremy Mulhall .50₵ per hour, effective August 5, 2013.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to grant permission to the residents of Cadman Avenue to hold a Block Party on Saturday, August 24th, 2013, from 12:00 Noon. to 11:00p.m., with a rain date of Saturday, August 31st,  2013.  The street will be blocked between Park Avenue and Locust Avenue, subject to parking restrictions for emergency purposes.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried,

BE IT RESOLVED that the calendars for the elected officials [Judge John J. Rafter] are hereby accepted as an accurate accounting of the average number of days worked per month per year.

And therefore

BE IT RESOLVED that the Village Board of the Village of Babylon hereby establish standard workdays for the attached for the purpose of determining days worked reportable to the New York State and Local Employees’ Retirement system:

The required Three month calendar logs have been submitted.  Based on the calendar logs the number of days per month to be reported for appointee is shown on the attached chart.  These calendars replace calendars previously submitted.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to allow a one-time sellback at the payroll of August 30, 2013, to permit employees with accrued time, in excess of 30-weeks, to sell back 6-weeks.  In the future, the option to sell back 2-weeks per year, with a maximum of 30-days, will be strictly adhered to.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to Village Sunoco to hang a 60ft. string of America Flag Bunting from the overhead canopy covering the fuel dispensers for 45 days.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the residents of Pilcher Street to hold a Block Party on Saturday, September 7th, 2013, from 12:00 Noon to 11:00p.m., with a rain date of Saturday, September 14th, 2013.  The street will be blocked between Park Way and Livingston Avenue, subject to parking restrictions for emergency purposes.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the residents of Ketewamoke Avenue to hold a Block Party on Saturday, September 7th, 2013, from 3:00 p.m. to 11:00 p.m.  The street will be blocked between Deer Park Avenue and Wampum Avenue, subject to parking restrictions for emergency purposes.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to authorize the Mayor of the Village of Babylon to sign a five (5) year contract with James E. Clark, Manager of Fair Hill Properties LLC, to lease a portion of the parking lot located at 42 Fire Island Avenue.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED that Judge Gowan be re-appointed as SPECIAL COUNSEL FOR TAX AND CERTIORARI PROCEEDINGS for one year at a rate of $175.00 per hour.

Trustee Amelia announced that Mike Carubia and the Great South Dixieland Jazz Band will be performing at the Gazebo this Friday, August 16, 2013, from 8:00 p.m. to 9:30 p.m.

On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant Hubert Walters a license to drive a taxi for Sunset Taxi in the Village of Babylon.

Mayor Scordino made the following announcements:

Please be advised that there will be no second Board Meeting in August.

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, September 2, 2013, in observance of the Labor Day Holiday. 

Just a reminder that residents cannot put rubbish or recycling out to the curb on holidays.   

These items should be put out the following week on your regular scheduled rubbish/recycling day.
