A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, July 29, 2014.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 4:45 p.m. On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, the meeting adjourned at 6:15 p.m.

Regular meeting of the Board of Trustees opened at 8:10 p.m.

The Pledge of Allegiance was lead by Trustee Davida.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the July 22, 2014 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue a refund in the amount of $438.02 to All Island Tax Grievance as per the attached Court Ordered Assessment Reduction for the 2010/11 Tax Year, for:

40 Coppertree Lane    (Section 16 Block 2 Lot 25)

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue a refund in the amount of $926.20 to the property owners, Thomas and Susan Coletti, as per the attached Assessor’s Petition for:

40 Coppertree Lane.   (Section 16   Block 2   Lot 25)

2011/12 Tax Year:       $454.38

2012/13 Tax Year:       $471.82

Total Refund:                $926.20

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the residents of Strong Avenue to hold a Block Party on Saturday, September 6, 2014, from 1:00 p.m. to 11:00 p.m., with a rain date of September 13, 2014.  The street will be blocked between Deer Park Avenue and Siegel Blvd., subject to parking restrictions for emergency purposes.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to accept the attached agreement with Nassau Builders [regarding the demolition of 67 Walbridge Road.]

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the attached Street Lighting agreement between the Town of Babylon and the Village of Babylon for the year June 1, 2014 through May 31, 2015 [at the rate of $1,309.17 per month ($15,710.05 per year)].

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the residents of Ketewamoke Avenue to hold a Block Party on Saturday, September 6, 2014, from 3:00 p.m. to 11:00 p.m.  The street will be blocked between Deer Park Avenue and Wampum Road, subject to parking restrictions for emergency purposes.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a refund in the amount of $50.00 to the applicant listed below for the return of two (2) ZBA signs for partial refund:

Trustee Basile advised there will be a photo exhibit at the Conklin House on Friday, Saturday and Sunday beginning September 19th.  There will be photos submitted as well as vintage post cards and photos from around the Village.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to issue a refund in the amount of $13.56 to George Bonetti for overpayment of taxes on 100 Bayview Avenue.       (Section 21   Block 2   Lot 8)

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to issue a refund in the amount of $14.79 to Bethpage Federal Credit Union for overpayment of taxes on 50 Cadman Avenue.          (Section 5   Block 2    Lot 63.1 )

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to issue a refund in the amount of $117.67 to Donald O’Brien for overpayment of taxes on 42 Peninsula Drive    (Section 13  Block 1 Lot 19.3)

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to grant permission to the residents of Roosevelt Street to hold a Block Party on Saturday, September 13, 2014, from 3:00 p.m. to 11:00 p.m., with a rain date of Sunday, September 14, 2014.  The street will be blocked between Deer Park Avenue and Siegel Blvd., with a barricade at Cleveland Street, subject to parking restrictions for emergency purposes.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to dispose of the following records as per the New York State Archives Records Retention Schedule MU-1:

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED that the Village of Babylon hold the annual S.T.O.P. (Stop Throwing Out Pollutants) Day on September 27, 2014, from 9:00 a.m. to Noon, with a paper shredding truck available to Village Residents.

Trustee Davida commented we have added a shredding truck this year for resident to bring their personal papers to be shred.  It will be done right in front of you so there will be nothing put to the side.  Residents will have to show identification that they do reside in the Village.

He also commented that last Saturday was the Village Swim meet which means swim lessons are now over!

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried,

BE IT RESOLVED that the calendars for the appointed officials listed on the attached chart (if required) are hereby accepted as an accurate accounting of the average number of days worked per month per year.

And therefore

BE IT RESOLVED that the Village Board of the Village of Babylon, hereby establish standard workdays for the purpose of determining days worked reportable to the New York State and Local Employees’ Retirement system:

All Elected and appointed Officials:  5 day work week, six hour day

Mayor’s secretary, Treasurer, Village Clerk, Village Justice Court, and all clerical staff:

5 day work week, seven hour day

Superintendent of Public Works and laborer staff: 5 day work week, eight hour day

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to decrease the assessment on the 2013/14 Tax Roll as per the attached Assessor’s Petition for 189 No. Railroad Avenue.  (Section 9   Block 1   Lot 55.1)

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the applicant listed below to drive a taxi cab for Lindy’s Taxi in the Village of Babylon:

Mayor Scordino made the following announcements:

Please be advised that there will be no second Board meeting in August.

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, September 1, 2014, in observance of the Labor Day Holiday.

Residents should not put rubbish or recycling out to the curb on holidays.  These items should be put out the following week on your regular scheduled rubbish / recycling day.

There will be a Public Hearing on Tuesday September 9, 2014, at 7:00 pm to consider the adoption of Local Law #4 of 2014 to amend Section 256-3 of the Village Code pertaining to Disturbing the Peace.

There will also be a Public Hearing on the same night to consider the application of Leo DeNicola LCJ & J, LLC  DBA DelFuego to make changes to the existing restaurant at 117 Deer Park Avenue.

Meeting was opened to the public;

Frank Curtin, 420 Fire Island Avenue, had questions regarding the Records Retention, and the house demolition resolutions.

Meeting adjourned at 8:30 p.m.
