A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, April 9, 2013.  On the motion of Trustee Davida, seconded by Trustee Amelia, and unanimously carried, the meeting was opened at 7:00p.m.  On the motion of Trustee Amelia, seconded by Trustee Basile, and unanimously carried, the meeting was adjourned at 7:25 p.m.

REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON WAS HELD IN THE BOARDROOM 153 WEST MAIN STREET BABYLON, NEW YORK ON TUESDAY,  APRIL 9, 2013

Regular meeting of the Board of Trustees opened at 8:02 p.m.

Mayor Scordino read the letter from the Fire Department:

The annual meeting of the General Convention of the Babylon Fire Department was held at

8:00 PM on Thursday, April 4, 2013, as prescribed by Article III, Section 1 of the Department

Bylaws.

            The purpose of the Convention was to elect nominees for the office of Chief of the Department, First Assistant Chief, Second Assistant Chief and Third Assistant Chief.

            The nominees receiving the majority of votes were as follows:

            Chief of the Department                   Paul Twardy

            First Assistant Chief                          Michael A. Sasuk

            Second Assistant Chief                      Scott A. Glenn

            Third Assistant Chief                         Michael A. Golub

            Please forward the results of the General Convention to the Village Board for their confirmation.

On the motion of Mayor Scordino, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

 

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to Splendor Foot Spa, 380 Deer Park Ave., to display a temporary sign advertising “Grand Opening”, for one month.

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Citizens Campaign for the Environment to canvass the Village of Babylon starting on April 9, 2013 to April 19, 2013, Monday to Friday, between the hours of 4:00 p.m. and 8:00 p.m.

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Community Scholarship Fund to display temporary signs from April 10, 2013 to May 7, 2013, in all Village storefronts, to advertise the 48th Annual Scholarship Dinner and Fashion Show.

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to increase the salary of Robert Kral $ 3,000, having completed his six month probationary period, effective April 9, 2013.

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue refund in the amount of $3,586 for assessment reduction on  

Section 10   Block  4  Lot  7,  as per the attached Stipulation of Settlement.

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue refund in the amount of $3,541 for assessment reduction on  

Section 6   Block  1  Lot  19,  as per the attached Stipulation of Settlement.

Trustee Basile announced that the artwork of local artist Elizabeth Karoly will be displayed at the Conklin House this weekend, Friday, April 19th from 7:00pm to 9:00pm, Saturday and Sunday, April 20th and 21st , from 12:00 noon to 3:00 p.m.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to hire Stanley Gooden as a part time sanitation laborer with a salary of $8.00 per hour effective April 1, 2013.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to issue refund in the amount of $220 to Nicholas Tanner, as he moved to a smaller boat berth at Main Dock.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to issue refund in the amount of $165 to Ed O’Connor, as he moved to a smaller boat berth at Main Dock.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to grant permission to Positions Dance Studio to display a temporary sign from April 29, 2013 to June 15, 2013, advertising their summer class offerings.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to grant permission to the Babylon Rotary Club to hold the Annual Babylon Village Classic 10K Run on August 18, 2013.  This would include assistance from the Village of Babylon Highway Department and Fire Department Rescue Squad.

Trustee Davida read the following:

APRIL 9, 2013

RESOLUTION TO DEMOLISH AND REMOVE AN UNSAFE BUILDING

WHEREAS, by memorandum dated July 26, 2012, the Building Inspector informed the Board of Trustees that the building on the Premises located 67 Walbridge Avenue, Babylon, New York , is unsafe; and

WHEREAS, the Building Inspector has previously notified the Owner of the Premises of the unsafe conditions and demanded that the owner take corrective action; and

WHEREAS, the Owner of the Premises has failed to take corrective action; and

NOW, THEREFORE, be it RESOLVED, that the Village Board hereby certifies, pursuant to Section 4-412 of the Village Law and Chapter 237 of the Village Code that the Building at 67 Walbridge Avenue, Babylon, New York is unsafe and that demolition and removal thereof are necessary and appropriate to protect the health, safety, and welfare of the Village residents; and be it further

RESOLVED, that the Village Attorney and its special counsel are authorized to Petition the Supreme Court of the State of New York to secure an Order authorizing the demolition and removal of the Building; and be it further

RESOLVED, that the Departments of Highways and of Sanitation under the direction and supervision of the Building Inspector are authorized to demolish and remove the Building; and be it further

RESOLVED, that the Village Treasurer shall account for all the costs incurred by the Village to secure the Supreme Court Order and to demolish and remove the Building and shall certify the aggregate sum thereof to the Assessor; and be it further

RESOLVED, that the Assessor shall assess the aggregate sum of all such costs as a special assessment against the Premises to assure reimbursement and collection thereof.

RESOLVED to accept the attached agreement with Nassau Builders Corp. and proceed with the demolition to 235 Ralph Ave.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to deny permission to Taylor Rowand of Vivint Solar to solicit door to door in the

Village of Babylon to sell residential solar systems.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to Tres Palm to have a comedian tell jokes on Wednesday

night, April 24, 2013, and an acoustic guitar player on Sunday afternoon, April 14, 2013, both

events to occur indoors.

 On the motion of Mayor Scordino, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to decrease assessments on the 2013 Assessment Roll as per the Assessor’s

Petitions attached.

Mayor Scordino read the following:

BOND RESOLUTION OF THE VILLAGE OF BABYLON, NEW YORK, authorizing the acquisition of four parking meter pay stations, stating the estimated maximum cost thereof is $70,000, appropriating said amount for such purpose, and authorizing the issuance of $70,000 serial bonds of said Village to finance and appropriation.

On the motion of Mayor Scordino, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to approve the minutes from the March 26th, 2013 regular Board Meeting and

dispense with the reading of the same.

Mayor Scordino made the following announcements:

The Board of Trustees will hold a Public Hearing on Tuesday, April 23rd, 2013, at 7:00 p.m., to consider the application of BurgerFi, BF NY Babylon, LLC, to operate a restaurant at 94 Deer Park Ave, Babylon, NY.

A Bid Opening is scheduled for Monday, April 22, 2013, at 9:30 a.m., for the Gilbert C. Hanse Municipal Pool Deck Resurfacing and Pool Railing.  Drawings and specifications and will be available on April 11, 2013, in the office of the Village Clerk.
