A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, April 16, 2019.  On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 4:10 p.m. On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried, the work session ended at 5:35 p.m. 

A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, April 23, 2019.  On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 7:06 p.m. On the motion of Trustee Silvestri, seconded by Trustee Davida and unanimously carried, the Board entered into Executive Session at 7:21 p.m. to discuss sensitive properties.  On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried, the Executive Session closed at 7:41 p.m. and the meeting adjourned.

Regular meeting of the Board of Trustees opened at 8:05 p.m.

The Pledge of Allegiance was led by Trustee Adams.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the April 9th, 2019 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated April 17, 2019:

At the regular monthly meeting of the Fire Council held April 16, 2019, the Fire Council took the following actions and we await your approval:

         Took off Sick Leave with Medical Clearance

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to Babylon Village Daisy Girl Scout Troop #1636 to use the Park Avenue tennis court parking lot (southeast courts) from 11:00 am to 3:00 p.m. on Sunday, May 5, 2019, to sell Girl Scout cookies.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Arts Council to display temporary signs at the three entrances to the Village indicated below to advertise the Arts by the Falls outdoor art exhibit:

                        At the intersection of John Street and Cooper Street

                        On Deer Park Avenue by Washington Street (by the Church)

                        At the east entrance to the Village on Main Street

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the American Legion, Babylon Post 94, to hold the annual Memorial Day Parade and Observance on Monday, May 27, 2019.  The parade will start at 11:00 a.m. at Foster Boulevard and Deer Park Avenue, proceed south on Deer Park Avenue to Montauk Highway, then west to the Gazebo, where the annual Memorial Day ceremony will be held.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Arts Council, in partnership with Babylon Village, to hold a chalk drawing event on Saturday, June 8th, 2019, from 11:00 a.m. to 3:00 p.m. in the Gazebo area.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon High School Class of 2020 to host a 3K–5K Color Run through the trails of Southard’s Pond on Saturday, May 18, 2019, from 10:00 a.m. to Noon, to raise funds for Children’s Cancer Research.  Babylon School Security and personnel will work the event, with assistance from Village Code Enforcement. Babylon High School shall comply with its submissions to the Board which form the basis for this approval.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an ‘additional insured’, as well as a signed and notarized ‘hold harmless’ agreement.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the following warrant for April 23, 2019:

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to increase the salary of Shawn Barnes .75₵ per hour having obtained his class D driver’s license, effective April 22, 2019.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to Stephanie Laudisis of Massapequa to maintain two signs on the building located at 504 Fire Island Avenue from April 24th to May 24th, 2019 as indicated:

            180” x 36” sign – “The Delica Sea Gourmet Deli”
              96” x 24” sign – “Hostess with the Mostess Events & Catering”

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to remove the exemptions as per the attached Assessor Petitions and bill the new owner(s) the Exempt Property Restoration for the Tax Year as indicated on the attached chart.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to the Babylon Little League to hold a Blood Drive on May 3rd, 2019, during the Peter Figoski Memorial Game, with the NY Blood Services Vehicle parked in the Locust Avenue parking lot [by the Little league storage containers] from approximately 3:00 p.m. to 10:00 p.m.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed & notarized ‘Hold Harmless’ Agreements from Babylon Little League and NY Blood Services.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to issue a refund in the amount of $650 to Mary Ellen McShane for boat slip #68 at Lewis Pond, which will be sublet for the 2019 season.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to schedule a Public Hearing to be held at 7:00 p.m. on Tuesday, May 14th, 2019,  to consider the application of Aldo Gervasi to amend the special use permit for Sal’s Famous Pizza, 128 North Carll Avenue.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant a license to the following applicants to drive a taxi cab for Lindy’s Taxi in the Village of Babylon:  Douglas Wood

The Mayor announced that this Saturday, April 27, 2019, is designated as Arbor Day in the Village of Babylon; Residents are encouraged to participate in the Beautification Society Arbor Day Program.

Mayor Scordino appointed Gerard Glass and Associates as Village Attorney pursuant to the retainer agreement on file with the Village Clerk (#1504).

The terms of said agreement provide that the fees shall be provided at a rate of $75,000.00 per year for all included services and at a rate of $300.00 per hour for all excluded services.
